摘要 | 互联网的快速更迭以及大数据、云计算等人工智能技术革新式发展推动数字经济蓬勃兴起,传统经济领域逐渐被数字经济所蚕食。大数据背景下的价格歧视行为作为数据技术和市场经济活动快速发展的产物,衍生于“大数据杀熟”,目前广泛应用于网络购物、交通出行、在线旅游等各种领域。大数据领域天然具有垄断性,经营者基于大数据和算法实施的价格歧视行为在扩大产出、提升市场配置效率之余,还可能造成消费者损害并联动第一线损害、扰乱市场竞争秩序等风险。党的二十大报告指出要加强反垄断和反不正当竞争,反垄断法作为促进市场竞争和保护消费者权益的工具,对大数据背景下价格歧视行为进行规制有必要性和正当性。因此,在现有反垄断法框架内,应当对大数据价格歧视行为进行竞争分析和法律论证。 本文通过分析大数据背景下价格歧视行为发生机理及特点,对大数据价格歧视行为进行界定,分析此类行为会带来破坏市场公平竞争秩序、创新驱动力减弱等消极影响,回溯反垄断法的基本理论,明确反垄断法规制的必要性。进一步 总结我国制度现状和实践案例,借鉴了基于民事权利保护的美国模式和侧重个人数据赋权的欧盟模式,尝试探讨大数据背景下价格歧视行为反垄断法规制存在问题及优化路径。首先,在相关市场界定方面,数字经济竞争策略和免费行为模式使传统市场界定方法的准确性难以保证。为此应改进相关市场界定方法,应由价格因素逐渐转向非价格因素方法,运用多因素判断法进行需求替代分析,并基于转移成本革新SSNIP测试法。其次,针对大数据背景下市场份额弱化和市场壁垒加强问题,应转变认定市场支配地位考虑要素,加强对数据壁垒的考量。在此基础上,解决立法和实践中对大数据价格歧视行为事实性要素难以认定问题,厘清“被歧视对象”、严格认定“相同交易条件”、确定“成本端”和“价格端”的判断标准,再对两端进行综合分析进行判断是否构成大数据价格歧视行为。最后,对于大数据价格歧视行为的反垄断执法应采用消费者福利损害标准,运用直接证据判断竞争效果,并构建效率抗辩和客观必要的经营抗辩,增加创新抗辩理由的应用,保护市场自由公平竞争,推动数字经济持续有序发展。 |
英文摘要 | The rapid change of the Internet and the innovative development of artificial intelligence technologies such as big data and cloud computing have promoted the vigorous rise of the digital economy, and the traditional economic field has been gradually eroded by the digital economy. The price discrimination behavior under the background of big data is a product of the rapid change and melting of data technology and market economic activities, derived from "big data killing", and is currently widely used in various fields such as online shopping, transportation, and online tourism. The field of big data naturally has monopolies, and price discrimination behavior implemented by operators based on big data and algorithms may not only expand output and improve market allocation efficiency, but also cause consumer damage and linkage with first line damage, disrupt market competition order, and other risks. The report of the 20th National Congress of the Communist Party of China pointed out the need to strengthen anti-monopoly and anti unfair competition. As a tool to promote market competition and protect consumer rights, it is necessary and legitimate to regulate price discrimination behavior in the context of big data. Therefore, within the existing framework of anti-monopoly laws, competition analysis and legal justification should be conducted on big data price discrimination behavior.
This article analyzes the mechanism and behavioral characteristics of price discrimination in the context of big data, defines the behavior of price discrimination in big data, and analyzes how such behavior can bring competitive damage such as disrupting market fair competition order and weakening innovation driving force. It traces the basic theory of anti-monopoly law and clarifies the necessity of regulating anti-monopoly law. Further summarizing the current situation and practical cases of China's system, drawing on the American model based on civil rights protection and the EU model focusing on personal data empowerment, this study attempts to explore the problems and optimization paths of anti-monopoly law regulation of price discrimination behavior in the context of big data. Firstly, in terms of market definition, the digital economy competition strategy and free behavior model make it difficult to ensure the accuracy of traditional market definition methods. To this end, relevant market definition methods should be improved, gradually shifting from price factors to non price factors, using multi factor judgment methods for demand substitution analysis, and innovating the SSNIP testing method based on transfer costs. Secondly, in response to the weakening of market share and the strengthening of market barriers in the context of big data, factors for determining market dominance should be transformed, and the consideration of data barriers should be strengthened. Furthermore, it
aims to address the difficulty in identifying factual elements of big data price discrimination in legislation and practice, clarify the "object of discrimination", strictly recognize the "same transaction conditions", determine the judgment criteria for the "cost side" and "price side", and then conduct a comprehensive analysis of both ends to determine whether they constitute big data price discrimination behavior. Finally, anti-monopoly law enforcement against price discrimination in big data should adopt consumer welfare damage standards, use direct evidence to judge competition effectiveness, and construct efficiency defenses and objectively necessary business defenses to increase the application of consumer benefit defenses, protect free and fair market competition, and promote the sustainable and orderly development of the digital economy. |
