随着我国建设工程市场的不断发展，建设工程领域的竞争日益激烈。在此背景下，串通投标行为成为一些企业追求不正当利益的手段，严重扰乱了建设工程市场的正常秩序，损害了国家利益、社会公共利益与他人的合法权益。为了保障建设工程领域的公平竞争，本文以建设工程领域串通投标行为为研究对象，分析其表现形式和负面影响等，探讨现有法律规制的不足，并提出针对性的改进对策。
首先，本文梳理了建设工程领域串通投标行为的概念、特征和表现形式，包括投标人与投标人、与招标人、与代理机构串通等。其次，分析了串通投标行为的负面影响，如损害建设工程领域公平竞争、产生腐败、损害社会公共利益等。在此基础上，本文将对此行为规制的理论依据进行了阐述，包括实质正义理论和社会本位理论。
随后，本文对我国现有关于建设工程串通投标行为的法律规定进行了梳理和简要的评析，并指出我国对此种行为的法律规制中存在的问题，如评标委员会制度不完善、监管体制规定欠科学、制裁力度规定过轻等。而后结合国外经验，提出对我国建设工程领域串通投标行为的法律规制的启示。
最后，针对我国法律规制存在的这些问题，本文提出了一系列完善建议，包括完善评标专家管理制度、对建设工程招投标集中统一监管、加大建设工程串通投标的制裁力度等，旨在为我国建设工程市场的健康发展提供有益的法治保障，希望可以有助于提高我国建设工程领域的竞争秩序和法治水平。

With the continuous development of China 's construction engineering market, the competition in the field of construction engineering is becoming increasingly fierce. In this context, collusion in bidding has become a means for some enterprises to pursue illegitimate interests, seriously disrupting the normal order of the construction project market and damaging the national interests, social public interests and the legitimate rights and interests of others. In order to ensure fair competition in the field of construction engineering, this paper takes the collusion bidding behavior in the field of construction engineering as the research object, analyzes its manifestations and negative effects, discusses the shortcomings of existing legal regulations, and puts forward targeted improvement countermeasures. 
First of all, this paper combs the concept, characteristics and manifestations of collusion bidding behavior in the field of construction engineering, including bidders and bidders, bidders and agents, etc. Secondly, it analyzes the negative effects of collusion bidding behavior, such as harming fair competition in the field of construction projects, generating corruption, and harming social and public interests. On this basis, this paper expounds the theoretical basis of this behavior regulation, including the theory of substantive justice and the theory of social standard.
Subsequently, this paper sorts out and briefly evaluates the existing legal provisions on the collusion bidding behavior of construction projects in China, and points out the problems existing in the legal regulation of this kind of behavior in China, such as the imperfection of the bid evaluation committee system, the unscientific regulation of the supervision system, and the lightness of the sanctions. Then, combined with foreign experience, it puts forward the enlightenment to the legal regulation of collusion bidding behavior in the field of construction engineering in China. 
Finally, in view of these problems existing in China 's legal regulation, this paper puts forward a series of suggestions for improvement, including improving the management system of bid evaluation experts, centralized and unified supervision of construction project bidding, and increasing the sanctions for construction project collusion bidding. It aims to provide a useful legal guarantee for the healthy development of China 's construction project market, hoping to help improve the competitive order and the level of rule of law in China 's construction project field.
