共享经济作为一种经济的新业态，利用互联网技术、定位技术、大数据收集整理等技术的发展和共享经济平台的出现，这样的新型经济模式正在蓬勃发展。按照消费者需求及功能特征进行划分，笔者选择具有代表性的，交通型共享经济平台运营中的法律问题进行研究分析。交通型共享经济平台运营模式符合绿色发展理念的特征与可持续发展理念相契合，是当下人们广泛参与最多的一种经济形式，同时也带来了一些问题，引起了社会的关注。交通型共享经济平台的法律关系与传统交通运输的法律关系存在差异，导致无法使用传统经济的法律制度有效规制交通型共享经济平台运营。新制定的《中共中央关于制定国民经济和社会发展第十四个五年规划和二〇三五年远景目标的建议》中明确提到要大力发展平台经济，鼓励引导其健康发展。现有研究多集中在交通型共享经济平台的某种单个平台运营模式，没有着眼于一个行业背景对这个共享经济平台运营的法律制度进行反思，本文着力于交通出行共享经济平台运营的法律问题研究，具有一定的研究价值。

本文从平台运营角度出发：文章第一部分是对相关文献的综述。第二部分对共享经济及平台相关基础理论进行分析，对交通型共享经济平台的概念及规制原则进行分析。第三部分首先对交通型共享经济平台的政策规制现状，对我国的交通型共享经济平台运营过程中的主体准入资格、资金风险、个人信息保护、平台间的不正当的竞争行为进行剖析。第四部分借鉴域外国家关于共享经济在规制过程中的监管经验、信用经验，劳动保障经验。第五部分结合我国共享经济发展独特的优势，对我国交通型共享经济平台运营中的问题提出法律规制建议。为其它类型的共享经济平台发展提供经验，为我国共享经济的健康有序发展助一臂之力。
